Article 1 – Definitions
In these General Terms & Conditions, the following definitions apply:
Flow Community Studio: the provider of classes, workshops, activities and other services under the name Flow Community Studio, based in Amsterdam.
Participant: any person attending or booking a class, workshop, activity or event at Flow Community Studio.
Member: a participant who has entered into a membership with Flow Community Studio.
Booking: a registration made through the online booking system, website or another booking method offered by Flow Community Studio.
Class: any group class offered by or on behalf of Flow Community Studio, including yoga, mindfulness, meditation and other movement or wellbeing activities.
Workshop: any creative, educational, mindful or other workshop offered by or on behalf of Flow Community Studio.
Credit: a prepaid credit that entitles a participant to attend an eligible class or activity within its validity period.
Membership: an ongoing agreement under which a participant is entitled to the benefits and activities included in the relevant membership.
Booking System: the online system designated by Flow Community Studio through which participants can book activities and manage their account, credits and/or membership.
Website: the official website of Flow Community Studio.
Article 2 – Studio Rules
2.1
Every participant is responsible for reading and complying with these General Terms & Conditions and the house rules of Flow Community Studio.
2.2
Flow Community Studio reserves the right to change its programme, opening hours, class schedules, workshops, activities, instructors and prices.
2.3
Flow Community Studio may refuse access to the studio or an activity if a participant behaves inappropriately, misuses the booking system, or behaves in a way that endangers the safety, peace or wellbeing of other participants or staff.
2.4
The studio is a non-smoking environment. Smoking and the use of drugs are not permitted in or around the studio.
2.5
Participants are expected to treat the studio, materials, furniture and other property of Flow Community Studio with care.
2.6
Food and drinks are only permitted when appropriate for the activity or when approved by Flow Community Studio. Water is permitted.
2.7
Pets are not permitted in the studio unless otherwise agreed in advance.
2.8
Flow Community Studio may temporarily close the studio or parts of the studio due to holidays, maintenance, renovations or other circumstances.
Article 3 – Applicability
3.1
These General Terms & Conditions apply to all agreements between Flow Community Studio and a participant relating to classes, workshops, activities, credits, passes and memberships.
3.2
By making a booking, purchasing credits or a pass, entering into a membership or participating in an activity at Flow Community Studio, the participant agrees to these General Terms & Conditions.
3.3
Any deviations from these terms are only valid if confirmed in writing by Flow Community Studio.
3.4
Flow Community Studio reserves the right to amend these General Terms & Conditions. The most recent version will be published on the Flow Community Studio website.
3.5
If a change materially disadvantages a participant with an ongoing membership, Flow Community Studio will inform the participant and the participant’s statutory rights will remain applicable.
Article 4 – Bookings and Participation
4.1
Participants must register in advance for classes and workshops where advance booking is required.
4.2
A booking is considered confirmed once it has been confirmed by the booking system or by Flow Community Studio.
4.3
Without a valid booking, a participant is not guaranteed access to an activity if the activity is fully booked.
4.4
Participants are responsible for selecting the correct activity, date and time when making a booking.
4.5
Participants are expected to arrive on time for their activity.
4.6
If a participant arrives late and participation is no longer considered safe or appropriate, Flow Community Studio may refuse participation. In such cases, the credit used for the booking may expire.
4.7
For a participant’s first visit, we recommend arriving a few minutes before the start of the activity.
Article 5 – Prices and Payment
5.1
The current prices for classes, workshops, credits, passes and memberships are stated on the Flow Community Studio website and/or in the booking system.
5.2
All stated consumer prices include VAT unless otherwise indicated.
5.3
Payment must be made using the payment methods offered by Flow Community Studio.
5.4
Classes, workshops, credits, passes and memberships must, unless otherwise agreed, be paid for in advance.
5.5
Flow Community Studio reserves the right to change its prices. Price changes do not affect credits that have already been purchased and are still valid, unless otherwise required by law.
5.6
Promotions, introductory offers and discount codes are only valid for the period and under the conditions stated at the time of the offer.
5.7
Credits cannot be exchanged for cash and cannot be transferred to another person without prior approval from Flow Community Studio.
Article 6 – Right of Withdrawal
6.1
When a consumer enters into an agreement online, a statutory 14-day right of withdrawal may apply in certain circumstances.
6.2
If a participant expressly requests that a service begin during the withdrawal period, for example by booking and/or attending a class or workshop, the right of withdrawal may cease or be reduced in accordance with applicable law.
6.3
All statutory exceptions and requirements relating to the right of withdrawal remain applicable.
Article 7 – Cancelling and Changing Bookings
7.1
A booking for a regular class may be cancelled free of charge up to [4 hours] before the start of the activity.
7.2
When a booking is cancelled within the permitted cancellation period, the credit used for the booking will, where applicable, be returned to the participant’s account.
7.3
When a booking is cancelled after the cancellation deadline, the credit used for the booking will generally not be returned.
7.4
If a participant does not attend an activity without cancelling the booking within the applicable cancellation period, this will be considered a no-show. The credit used for the booking will generally expire.
7.5
Different cancellation terms may apply to workshops, events and activities for which materials or other costs are incurred in advance. These terms will be clearly stated at the time of booking.
7.6
In exceptional personal circumstances, Flow Community Studio may, at its discretion, make an exception to the cancellation policy.
Article 8 – Cancellation by Flow Community Studio
8.1
Flow Community Studio reserves the right to cancel or reschedule a class, workshop or other activity.
8.2
If Flow Community Studio cancels an activity, participants will be informed as soon as reasonably possible.
8.3
If an activity is cancelled by Flow Community Studio, the credit used will be returned or, where applicable, another appropriate solution will be offered.
8.4
Flow Community Studio is not responsible for any additional costs incurred by a participant as a result of a cancelled activity, to the extent permitted by law.
Article 9 – Credits and Passes
9.1
Each pass or credit package has a specific validity period. This period is stated at the time of purchase.
9.2
A credit entitles the participant to attend the activities for which that credit is valid.
9.3
A credit can only be used once.
9.4
Unused credits automatically expire when the stated validity period ends.
9.5
Expired credits will not automatically be extended or refunded, unless Flow Community Studio decides otherwise or applicable law requires this.
9.6
Credits are personal and may not be transferred to third parties without prior approval from Flow Community Studio.
9.7
In exceptional circumstances, such as prolonged illness, injury or pregnancy, Flow Community Studio may, upon request, extend or temporarily suspend the validity of credits. Flow Community Studio may request supporting information where appropriate.
Article 10 – Memberships
10.1
A membership entitles the participant only to the benefits, classes, credits and other facilities included in the relevant membership.
10.2
The price, duration, minimum term, notice period and other conditions of a membership will be clearly stated when the membership is purchased.
10.3
Memberships are personal and may not be transferred to another person without prior approval from Flow Community Studio.
10.4
Where a membership is an ongoing agreement, it will automatically renew in accordance with the terms communicated when the membership was purchased.
10.5
Participants may cancel their membership subject to the applicable notice period and statutory consumer rights.
10.6
Where a membership includes monthly credits, these credits are subject to the conditions stated for the relevant membership.
10.7
Flow Community Studio may temporarily suspend a membership where this has been agreed in advance or where the membership terms provide for such a possibility.
Article 11 – Workshops and Materials
11.1
Workshops may have a limited number of available places.
11.2
A place at a workshop is reserved after successful payment and/or confirmation of the booking.
11.3
The materials included in a workshop are stated in the description of the relevant workshop.
11.4
When participants create products or artworks during a workshop, the final result may differ from examples or images shown beforehand. This is part of the creative process.
11.5
Materials provided by Flow Community Studio may only be used for the purpose for which they are provided.
Article 12 – Health and Personal Responsibility
12.1
Participation in classes, workshops and other activities at Flow Community Studio is at the participant’s own responsibility.
12.2
Participants are responsible for determining whether an activity is suitable for their personal circumstances.
12.3
Participants should inform the instructor or a Flow Community Studio staff member in advance about relevant physical limitations, injuries, pregnancy, allergies or other circumstances that may affect safe participation.
12.4
Instructions given by instructors and staff must be followed at all times.
12.5
Activities offered by Flow Community Studio are not a substitute for medical or psychological treatment or professional medical advice.
12.6
If an instructor or staff member considers participation to be unsafe or inappropriate, the participant may be asked not to participate or to stop participating in the activity.
Article 13 – Liability
13.1
Participation in activities and use of the facilities of Flow Community Studio is at the participant’s own risk.
13.2
To the extent permitted by law, Flow Community Studio is not liable for damage arising from participation in an activity, except where such damage results from intent or wilful recklessness on the part of Flow Community Studio, or where liability cannot legally be excluded.
13.3
Flow Community Studio is not liable for loss, theft or damage to personal belongings brought into the studio by participants.
13.4
Participants are responsible for damage they intentionally or negligently cause to property belonging to Flow Community Studio.
13.5
To the extent permitted by law, the limitations of liability in this article also apply to instructors, employees, volunteers and third parties engaged by Flow Community Studio.
Article 14 – Conduct and Safety
14.1
Flow Community Studio aims to provide a safe, respectful and inclusive environment.
14.2
Participants are expected to treat other participants, instructors, employees, volunteers, materials and the studio with respect.
14.3
Discrimination, harassment, aggression, unwanted sexual behaviour and other forms of inappropriate or harmful behaviour are not tolerated.
14.4
In cases of serious or repeated inappropriate behaviour, Flow Community Studio may immediately deny a participant access to an activity or the studio.
14.5
In the event of exclusion due to inappropriate behaviour, the participant is generally not entitled to a refund for a booking that has already been paid for.
Article 15 – Photography and Video
15.1
Photographs and videos may be taken during activities and events at Flow Community Studio.
15.2
When identifiable images are used for marketing, social media or other promotional purposes, Flow Community Studio will comply with applicable privacy laws and obtain consent where required.
15.3
Participants who do not wish to appear recognisably in photographs or videos can inform a Flow Community Studio staff member before or during the activity.
15.4
Flow Community Studio will make reasonable efforts to respect requests not to appear recognisably in promotional material.
Article 16 – Personal Data and Privacy
16.1
Flow Community Studio processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation.
16.2
Personal data may be used to process bookings, payments and memberships, communicate with participants, provide customer service and fulfil agreements.
16.3
For more information about how personal data is processed, please refer to the Flow Community Studio Privacy Policy.
16.4
Participants have the rights granted to them under the GDPR, including, where applicable, the right to access, correct and request deletion of their personal data.
Article 17 – Complaints
17.1
Flow Community Studio takes complaints and feedback seriously and aims to handle them carefully and respectfully.
17.2
Complaints can be submitted via hello@flowcommunity.nl
17.3
Participants are encouraged to report a complaint as soon as reasonably possible after the issue arises or is discovered, so that Flow Community Studio has the opportunity to investigate and, where possible, resolve the matter.
17.4
Flow Community Studio aims to respond to complaints within a reasonable period.
Article 18 – Force Majeure
18.1
Flow Community Studio is not required to fulfil an obligation when it is prevented from doing so by circumstances that are reasonably beyond its control.
18.2
Force majeure may include, but is not limited to, instructor illness, technical failures, fire, water damage, government measures, extreme weather conditions, power outages or other circumstances that make it reasonably impossible for an activity to take place.
18.3
In the event of force majeure, Flow Community Studio will make reasonable efforts to offer an alternative date or another appropriate solution where possible.
Article 19 – Intellectual Property
19.1
Lesson materials, texts, images, methods, creative concepts and other materials developed by or on behalf of Flow Community Studio remain the property of Flow Community Studio or the relevant rights holder.
19.2
These materials may not be commercially copied, distributed or used without prior permission.
19.3
Personal creations made by participants during workshops may, of course, be taken home and used for personal purposes unless stated otherwise in advance.
Article 20 – Changes to the Terms & Conditions
20.1
Flow Community Studio may amend these General Terms & Conditions when necessary.
20.2
The most recent version will be published on the Flow Community Studio website.
20.3
The statutory rights of consumers and participants remain unaffected by any changes to these terms.
Article 21 – Governing Law
21.1
These General Terms & Conditions and all agreements between Flow Community Studio and the participant are governed by Dutch law.
21.2
Any disputes will, where possible, first be resolved through mutual consultation.
21.3
If a dispute cannot be resolved amicably, it will be submitted to the competent court in accordance with applicable law.
